Transparency panel's order on NRI hotelier restrained
New Delhi, June 29 (IANS) The Delhi High Court Wednesday stayed a Central Information Commission (CIC) order directing the Central Bureau of Investigation (CBI) to release probe reports on allegations against NRI hotelier Sant Singh Chatwal.
The CBI refused to provide the information to a right to information (RTI) applicant, stating that details sought regarding two cases, which were disposed, were linked to two more cases pending trial.
The CBI claimed it was exempted from disclosing the information.
Taking note of the CBI application, Justice M.L. Mehta stayed the CIC's May 11 order and issued notice to RTI applicant Krishnanand Tripathi, a TV journalist, seeking his response by July 28.
"Any disclosure would impede the process of investigation, arrest or prosecution," said the CBI in its petition.
"The CBI cannot be compelled by any authority to supply any document or information relating to the cases," the agency said.
The RTI applicant sought a copy of the legal opinions given after discharge of Chatwal in two cases the CBI had filed against him in connection with alleged bank fraud. The applicant also wanted copies of the charge sheet filed against Chatwal.
Between 1992 and 1994, the CBI registered four cases against Chatwal and some bank officials for allegedly conniving with the intention of defrauding Bank of Baroda and Bank of India.
"Two of these cases against Chatwal were closed by the CBI after a Mumbai court discharged all the accused in 2007," the petition said.
