Kanimozhi, Sharad Kumar move Supreme Court for bail
New Delhi, June 10 (IANS) DMK MP Kanimozhi and Kalaignar TV managing director Sharad Kumar, who are in jail in connection with the 2G spectrum scam, Friday moved the Supreme Court for bail after the Delhi High Court rejected their petitions.
The petition will come up for hearing Monday before the vacation bench of Justice B.S. Chauhan and Justice Swatanter Kumar.
Both Kanimozhi and Sharad Kumar are charged as co-conspirators and beneficiaries in the 2G spectrum scam for allegedly accepting Rs.214 crore as bribe and are lodged in Tihar Jail since May 20.
Kanimozhi, daughter of DMK chief M. Karunanidhi, has challenged the Delhi High Court's Wednesday verdict that rejected her bail plea on the ground of the possibility of her tampering with witnesses and evidence.
Kanimozhi and Sharad Kumar in their petition have contended that the Rs.214 crore given to Kalaignar TV was only a loan and not a bribe as alleged by the prosecution agency. The petitioners have said the transaction was transparent and the payment was made through cheque.
They also said the loan they had taken was paid back. The petition said there was no conspiracy between Kanimozhi, Sharad Kumar and former telecom minister Andimuthu Raja, an accused. Kanimozhi has said she had nothing to do with allocation of 2G licences and spectrum.
Seeking the setting aside of the high court verdict of Wednesday, the petition said that the high court has not considered the material placed before it in a correct perspective.
While dismissing their plea for bail, the high court said that given their political and money influence, Kanimozhi and Kumar were capable of tampering with evidence and influencing the witnesses.
Former communications minister Andimuthu Raja is already in jail in connection with the case.
