Court rejects exemption plea of Kanimozhi, Kumar (Lead)

New Delhi, May 7 (IANS) A plea by DMK MP Kanimozhi and Kalaignar TV chief Sharad Kumar for exemption from personal appearance in the court in the second generation (2G) telecom spectrum case was rejected by a special Central Bureau of Investigation (CBI) court here Saturday.

 
 Judge O.P. Saini said, “This order shall dispose of an application  filed by accused Kanimozhi and Kumar for exemption from personal appearance in the court May 9-10.”
 
 Counsel Shunmugasundaram said the duo wished to visit Chennai in order to meet their auditors to prepare their replies to be filed before the Enforcement Directorate (ED), for which they have been summoned May 12-13.
 
 "Their presence in Chennai is necessary for two days for preparing their defence,” said defence counsel.
 
 However, the CBI opposed the application, saying that pending disposal of the bail plea, such application cannot be allowed.
 
 "If their presence at Chennai is necessary, then it may be allowed for any one of the two accused,” said the CBI's counsel.
  
 The judge said, “The bail applications for both accused were heard and concluded during the course of the day, and are now listed for order May 14.”
 
 Earlier, Karim Morani of Cineyug Films got an exemption as he is admitted to Mumbai's Lilavati Hospital.
 
 The CBI had named the five co-accused, along with the former telecom minister A. Raja, his aide R.K. Chandolia, former telecom secretary Siddhartha Behura and Swan Telecom promoter Shahid Balwa for conspiring to sell valuable 2G spectrum waves to select companies at rock bottom prices.
 
 Later, the probe agency also named Tamil Nadu Chief Minister M. Karunanidhi's daughter Kanimozhi as co-conspirator in the case, while his wife Dayalu Ammal was listed as a witness.
 
 A Rajya Sabha member, Kanimozhi was named along with Kumar, Morani, Asif Balwa and Rajiv B. Agarwal of Kusegaon Realty.
 
 Among the accused, Raja, Chandolia, Behura, Shahid Balwa, Asif Balwa, Agarwal, Goenka, Chandra, Doshi, Nair and Pipara are in judicial custody.
